Unclaimed items policy
DRAFT, pending legal review. Prototype wording for counsel to review and replace. Not a binding policy and not legal advice.
We try twice, remind you often, store for 30 days, and may donate after 90.Choose a new delivery time from any reminder text and nothing else happens.
Delivery tries
Two delivery tries are included. If we can’t hand your items over (no answer, no access, or delivery on hold because a card couldn’t be updated), we text you to pick a new time. A third try is free if you book it.
Timeline from the day your items are ready
| Day | What happens |
|---|---|
| 0 | Items pass quality check. We book delivery. |
| After 2 failed tries | Text and email: choose a new time. |
| 18 and 28 | Reminders: “Your items move to storage on day 30.” We call once before day 30. |
| 30 | Items move to storage. They’re bagged and kept clean. You can still book a delivery anytime. |
| 60 and 85 | Reminders from storage, by text, email and letter to your address. |
| 90 | Items may be donated to a local charity or recycled. We text you first. |
Payment
We charge for the approved work only when items are delivered. If items are donated after 90 days, we may charge the approved work to your saved card.
For counsel: Confirm NY rules on disposing of customers’ unclaimed goods (e.g. the NY Lien Law notice-before-sale/disposal requirements for bailees), the required notice method (certified mail?), and whether charging for work on donated items is allowed. Decide whether any storage fee applies after day 30 (draft says none).
